These Terms of Service (“Terms”) govern your access to and use of our website located at https://smartctc.com (the “Website”) and the services we provide, including automated Clean Truck Check compliance devices and subscriptions (the “Services”).

By accessing or using the Website or Services, you agree to be bound by these Terms and our Privacy Policy (available at https://smartctc.com/privacy). If you do not agree to these Terms, please do not use the Website or Services.

By requesting a quote, subscribing, or otherwise engaging our Services, you affirmatively agree to these Terms.

These Terms apply to all visitors and users of the Website and Services.

Use of the Website and Services

You may use the Website and Services only for lawful purposes and in accordance with these Terms. The Services are intended for users in the United States and Canada who require CARB Clean Truck Check compliance. You represent that you are at least 18 years old and have the authority to enter into these Terms.

Nature of Services: Our Services are provided solely for the purpose of facilitating CARB Clean Truck Check inspections as required by applicable regulations. Services may be used by both businesses and individuals, including owners of personally owned vehicles subject to Clean Truck Check requirements. The Services are not intended for personal, household, or recreational purposes unrelated to regulatory compliance.

We reserve the right to modify, suspend, or discontinue the Website or Services (or any part thereof) at any time without notice. We will not be liable for any such changes or unavailability.

Quotes, Subscriptions, and Payments

You may request quotes for Services through the Website. Quotes are subject to availability and confirmation by us.

Services are offered on a "Device-as-a-Service" subscription model or per-test basis. For subscriptions:

The term is one year and does not automatically renew. You may renew at the same rate prior to expiration.
If not renewed, you may purchase the device for $155 plus applicable sales tax or return it in good condition.

Payments are processed via third-party providers like Stripe. By providing payment information, you authorize us to charge the applicable fees. We do not store full payment card details.

We reserve the right to refuse or cancel any quote or subscription for reasons including, but not limited to, errors in information or suspected fraud.

Refunds and Cancellations

Payments for Services are non-refundable except as required by law or at our sole discretion. If you need to cancel, please contact us as soon as possible.

Warranty and Replacements

The device is warrantied for the entire active subscription period (and renewals). If it cannot be repaired remotely, we will ship a replacement at no cost, including a postage-paid return label for the faulty device.

Service Guarantee

If a Clean Truck Check test cannot be completed due to device malfunction or cellular connectivity issues, we guarantee a comprehensive service response. This includes arranging, at no cost, a mobile test by a CARB-Credentialed HD I/M Tester of our choice within Los Angeles County, California. Claims must be submitted by email to [email protected] no earlier than 30 calendar days and no later than 7 calendar days before the test deadline.

Compliance Responsibility

It is your responsibility to monitor your vehicle's compliance status and confirm test results on the CTC-VIS portal. We offer assistance with the portal at no additional charge.

No Guarantee of Regulatory Compliance

Our Services are provided solely to facilitate participation in the CARB Clean Truck Check program. We do not guarantee regulatory compliance, test results, approval, acceptance, or enforcement outcomes by CARB or any governmental authority. All compliance obligations remain solely the responsibility of the vehicle owner or operator, and use of our Services does not relieve you of any legal or regulatory duties.

Force Majeure

We shall not be liable for delays or failure to perform resulting from causes beyond our reasonable control, including but not limited to weather conditions, vehicle access issues, governmental actions, system outages, labor shortages, or acts of God.

Intellectual Property

The Website and its content, features, and functionality (including text, graphics, logos, and images) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or use any part of the Website without our prior written consent.

Third-Party Links and Services

The Website may contain links to third-party websites or services (e.g., Google, Meta, Stripe, CARB CTC-VIS). We are not responsible for the content, privacy practices, or availability of these third parties. Your use of them is at your own risk. We do not control, operate, or guarantee the services, systems, availability, or determinations of CARB or any other governmental or third-party entities. We do not control, operate, or guarantee the availability, accuracy, timing, or determinations of CARB or any governmental systems or databases.

Disclaimer of Warranties

The Website and Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Website will be error-free, secure, or uninterrupted.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the Services in the past 12 months for the specific Services giving rise to the claim.
